Dessa forma, a turma estabeleceu a interpreta\u00e7\u00e3o de que a entrega do im\u00f3vel e o pagamento integral impedem a reivindica\u00e7\u00e3o do consumidor de exercer o direito de desist\u00eancia para anular o contrato.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559731&quot;:708,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">No processo analisado pelo Superior Tribunal de Justi\u00e7a (STJ), o comprador ingressou com uma a\u00e7\u00e3o de rescis\u00e3o contratual argumentando que a propriedade n\u00e3o foi entregue integralmente, uma vez que alguns dos aparelhos prometidos para o empreendimento n\u00e3o estavam devidamente finalizados. Nesse sentido, o tribunal de primeira inst\u00e2ncia julgou o pedido a\u00e7\u00e3o como improcedente, argumentando que o contrato j\u00e1 havia sido integralmente quitado e, portanto, n\u00e3o poderia ser rescindido; e o Tribunal de Justi\u00e7a de S\u00e3o Paulo (TJSP) concedeu parcial provimento \u00e0 apela\u00e7\u00e3o.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559731&quot;:708,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">A desist\u00eancia por mera vontade do consumidor acarretaria uma inseguran\u00e7a jur\u00eddica, como salientado pela relatora do recurso Ministra Nancy Andrighi, ao restabelecer a decis\u00e3o de primeira inst\u00e2ncia. Ela explicou, com base em precedentes do tribunal, que o direito de desist\u00eancia \u00e9 justificado quando as obriga\u00e7\u00f5es se tornam onerosas demais para o consumidor, fato n\u00e3o comprovado no caso em an\u00e1lise.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559731&quot;:708,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">O processo indica ainda que o consumidor utilizou o im\u00f3vel adquirido em pelo menos duas ocasi\u00f5es.
