text-decoration-none text-strikethrough-none\">da concretiza\u00e7\u00e3o da loca\u00e7\u00e3o \u00e0 reforma do im\u00f3vel alugado!<\/span><\/p>\n<p>Parte 3<\/p>\n<p class=\"cvGsUA direction-ltr align-justify para-style-body\"><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">Como vimos no informativo anterior, pode ocorrer de o <\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">locat\u00e1rio realizar reformas no im\u00f3vel durante o prazo da loca\u00e7\u00e3o<\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">, as quais podem ocasionar a <\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">valoriza\u00e7\u00e3o do bem<\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">.<\/span><\/p>\n<p class=\"cvGsUA direction-ltr align-justify para-style-body\"><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">O risco para que o pre\u00e7o do aluguel aumente ap\u00f3s o locat\u00e1rio (inquilino) realizar eventuais reformas que valorizem o im\u00f3vel existe quando o <\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">contrato de loca\u00e7\u00e3o firmado entre as partes deixa d\u00favidas a respeito: (i) do tema ou (ii) da forma de corre\u00e7\u00e3o do valor<\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">.<br \/>\n<\/span><\/p>\n<p class=\"cvGsUA direction-ltr align-justify para-style-body\"><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">O contrato deve ser elaborado pensando justamente nestes f<\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">uturos impasses entre as partes<\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\"> para que ningu\u00e9m tenha um benef\u00edcio desproporcional ou que represente um enriquecimento sem causa.<\/span><\/p>\n<p class=\"cvGsUA direction-ltr align-justify para-style-body\"><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">Ademais, h\u00e1 a possibilidade de que o contrato de loca\u00e7\u00e3o seja revisado em comum acordo entre as partes, sendo que, caso alguma das partes n\u00e3o concorde, o meio para buscar a readequa\u00e7\u00e3o do valor do aluguel \u00e9 uma<\/span> <span class=\"OYPEnA text-decoration-none text-strikethrough-none\">a\u00e7\u00e3o revisional judicial<\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">.<\/span><\/p>\n<p class=\"cvGsUA direction-ltr align-justify para-style-body\"><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">\u00c9 importante ainda nos atentarmos que, normalmente, independente de reformas, os<\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\"> alugu\u00e9is sofrem uma corre\u00e7\u00e3o monet\u00e1ria<\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\"> prevista em contrato, de acordo com circunst\u00e2ncias de mercado e do pr\u00f3prio im\u00f3vel, <\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">o que n\u00e3o se confunde com eventual aumento por valoriza\u00e7\u00e3o do bem<\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">.<\/span><\/p>\n<p class=\"cvGsUA direction-ltr align-justify para-style-body\"><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">Assim, ap\u00f3s a realiza\u00e7\u00e3o de reformas em um im\u00f3vel locado, o propriet\u00e1rio tem o direito de propor um aumento no aluguel, desde que isso esteja em conformidade com o contrato de loca\u00e7\u00e3o e as leis vigentes. <\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">A negocia\u00e7\u00e3o e documenta\u00e7\u00e3o s\u00e3o essenciais nesse processo<\/span><span class=\"OYPEnA text-decoration-none text-strikethrough-none\">.
